Capital punishment, or the death penalty, is the execution of a person by judicial process as a punishment for an offense. Crimes that can result in a death penalty are known as capital crimes or capital offences. The term capital originates from Latin capitalis, literally "regarding the head" (Latin caput). Hence, a capital crime was originally one punished by the severing of the head.

Capital punishment has in the past been practiced in virtually every society, although currently only 58 nations actively practice it, with 95 countries abolishing it (the remainder having not used it for 10 years or allowing it only in exceptional circumstances such as war)[10]. It is a matter of active controversy in various countries and states, and positions can vary within a single political ideology or cultural region. In the EU member states, Article 2 of the Charter of Fundamental Rights of the European Union prohibits the use of capital punishment.

Today, most countries are considered by Amnesty International as abolitionists, which allowed a vote on a nonbinding resolution to the UN to promote the abolition of the death penalty. But more than 60% of the worldwide population live in countries where executions take place insofar as the four most populous countries in the world (the People's Republic of China, India, United States and Indonesia) apply the death penalty and are unlikely to abolish it at in the near future.

Why do people think the death penalty is the worst punishment?
Q. I think life in prison is the worst punishment because you are in there for life. The death penalty if you don't appeal you can be executed in a fairly short time. So you are in jail for a much shorter time.

A. I would have to agree with you. You lose your free will, your family, your future, your life is run by gangs, you get raped when you can't defend yourself, you get stabbed if you don't follow orders... I suppose your mind could become so warped that you would adapt to that sort of life. Some prisoners even come to love the men who protect them, and take on the role of a wife. Personally, I think its the same as a lifetime of torture, and I would rather keep my integrity and die.

Can the death penalty be invoked on the Somali pirates who kidnapped Captain Richard Phillips?
Q. Pirates will continue pirating and more will join their ranks unless these Somali pirates are caught and made an example of. Can they be prosecuted? If so, by which court of law? And can the death penalty be invoked in this case?

A. They should never make it to shore. politics is what is keeping them in business. Foreign governments have let it go on too long but I think it has come to a ahead now. Obama has no balls so where it goes from here??? The seals could end it in 10 minutes without loss of American lives. The pirates are already dead if the navy seals take control.Nimo l is not very observant.They are well out of Somali territory , in international waters and they are Petty, cowardly pirates.

What crimes have to be committed to get the death penalty?
Q. i'm doing research for states that have the death penalty. I only need to find one more state and thats Texas and i can't find anything. Please help.

A. Under the current Texas Constitution and state laws, only the crime of "capital murder" or a second conviction for the rape of someone under 14 is eligible for the death penalty (though the recent Supreme Court case Kennedy v. Louisiana removed the death penalty option for repeat rapists).
